OWNERS AND CONTRACTORS PROTECTIVE LIABILITY COVERAGE FORM ELIGIBILITY

Property owners, construction project owners, and general contractors are the only entities qualifying as named insureds on the CG 00 09–Owners and Contractors Protective Liability Coverage Form–Coverage for Operations of Designated Contractor. They are eligible only if they use independent contractors or subcontractors to perform operations on their behalf. There is no requirement as to the type of operations the contractor performs for the named insured. As a result, operations may be personal, farm, or commercial in nature. The only requirement is that there is potential vicarious liability for the named insured because of the contractor and the work that contractor performs on the named insured’s behalf.

The CG 00 09 cannot be combined with other policies as its provisions are not compatible with provisions in other coverage forms. This incompatibility is most obvious with regard to premium payments. It is the contractor, not the named insured, who is responsible for premium audit or premium payment.

There is one exception to the above rule. When the CG 00 09 is converted to a Principals Protective Liability Coverage Form using CG 28 07–Principals Protective Liability Coverage, the named insured becomes the party responsible for paying the premium so that the coverage is then considered compatible with other coverage forms so that the CG 00 09 plus CG 28 07 can be included in a package policy.
